Personal data means any information relating to an identified or identifiable natural person. With this data protection notice we inform you about the nature, scope and purpose of the collection of personal data and how we handle this data. In addition, we would like to inform you about your rights with regard to the processing of your personal data.
This data protection notice applies to the processing of personal data for the entire duration of our recruitment process. Mercedes-Benz.io Portugal and Germany carry out a joint recruitment process.
The joint personal data processing is regulated by a Joint Controllership Agreement and both companies are bounded by the Mercedes-Benz Data Protection Policy that you can find here.

Where does my data come from and what data is processed?
We process the following personal data that we have received from you:
- Identification data (such as name, email, phone number, nationality, and social media user names, among others)
- Professional background data (such as CV, past experiences, language skills, and cover letter, among others)
- Recruiting process data (such as technical assessments, e-mails exchanged with recruiters, positions applied, and your feedback regarding the process, among others)
- Job offer data (such as salary offer, internal hierarchy level, and salary expectations, among others)
In addition, we may also process personal data that we have received from other sources, especially if you connect any external account to our Application Tracking System (e.g., application with LinkedIn profile). Regardless, we will never process personal data from other sources by our own initiative and without your consent.
What is the purpose of processing the data and what is the legal basis?
We process your personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and national laws (e.g., German Federal Data Protection Act (BDSG)) only with a legal basis or prior given consent and exclusively for the permitted purposes.
The purpose of the data processing is to carry out our recruitment process as the basis for a potential establishment of an employment relationship. The primary legal basis for this is Art. 6 para. 1 lit. a GDPR in conjunction with Art. 88 para. 1 GDPR and § 26 (1) BDSG.

How long will my data be stored?
We only store your personal data for as long as you maintain your consent. If you do not renew your consent, either by direct contact with the recruiter or through our Applicant Tracking System, your personal data will be deleted 6 (six) months after the initial date of collection.
Will my data be transferred?
We use processors to carry out our recruitment process in the most efficient way available. For the purpose of provision of an Application Tracking System we transfer your data to processors (e.g., software providers). The transfer of your data to them takes place under strict compliance with the requirements of the GDPR, including a Data Processing Agreement. Processors are only allowed to process the data for our purposes but not for their own and are obliged to comply with the standards of the Mercedes-Benz Group.
Will my data be transferred to a third country?
Your personal data will not be transferred to countries outside the EU/EEA (third countries).
What rights do I have as a data subject?
As a data subject, you have the following rights:
Art. 15 GDPR: Right of access – You have the right to view and request copies of their personal data
Art. 16 GDPR: Right to rectification – You have the right to request inaccurate or outdated personal information be updated or corrected.
Art. 17 GDPR: Right to have your data deleted - Data subjects have the right to request their personal data be deleted. Note that this is not an absolute right and may be subject to exemptions based on certain laws
Art. 18 GDPR: Right to restriction of processing of your personal data. This means that your data will still be stored, but may only be processed under limited conditions (e.g., with your consent or to assert legal claims).
Art. 20 GDPR: Right of data portability. You have the right to receive your personal data, which you have provided to the controller, in a structured, commonly used, and machine-readable format.

For the establishment, fulfilment or execution of the business relationship as well as for pre-contractual measures, there are no fully automated individual decision-making according to Art. 22 GDPR.
You have the right to lodge a complaint with the data protection officer or a data protection supervisory authority if you believe that the processing of personal data concerning you violates the GDPR or other laws (Art. 77 GDPR). The competent supervisory authorities are:
